separation as ground for divorce There is evidence that a marriage has broken down irretrievably if: the parties to the marriage have lived apart for a continuous period of a least two years immediately preceding the presentation of the petition and the respondent consents to the granting of a decree; the parties have lived apart for a continuous period of at least five years immediately preceding the presentation of the petition.
