records admissible in criminal cases Records in criminal proceedings which are admissible in evidence, i.e., when the record was compiled by a person acting under a duty from information supplied by a person (whether acting under a duty or not) who had, or might reasonably be supposed to have had, personal knowledge of the matters dealt with in that information (a) is dead or is mentally or physically unfit to act as a witness; (b) is abroad and cannot reasonably be called as a witness; or (c) cannot reasonably be expected to have any active recollection of the matters in question. Further requirements include taking all reasonable steps to identify the supplier of information and to locate him. Comparable requirements apply to the use of computer records. |
