bail Release of a person or arrested on his giving security or accepting specified conditions. A person arrested may be granted bail under a duty to surrender to custody. No recognisance for his surrender to custody may be taken from him: He may be required to provide a surety to secure his surrender. On withholding of bail he may apply to the Court. Bail need not be granted if the court is satisfied that there are substantial grounds for believing that the defendant, if released, would fail to surrender to custody, or would commit an offence while on bail or interfere with witnesses. |
