apportionment of contract The division of a contract into several distinct acts, or parts, the performance of one or more of which may give the right to enforce the contract to that extent against the other party. If some parts are lawful and some unlawful, the lawful parts can be enforced, while the unlawful are void, unless the consideration is illegal, when the whole contract is void.
