rescission Remedy for inducing a contract by innocent or fraudulent misrepresentation, whereby the contract is abrogated. A party intending to rescind must notify the other party. Right of rescission is lost: if restitutio in integrum is impossible; if the injured party takes a benefit under the contract with the knowledge of the misrepresentation; if a third party has acquired for value rights under the contract. |
