proviso 1. In a deed, a condition upon which its general validity is based. May begin: .... provided always that.... 2. In a statute, a clause qualifying or exempting from the enactment something which, but for the proviso, would have been included. It is construed with the preceding part of the clause of which it is attached. It never enlarges an enactment unless that is unavoidable. |
