prescription Generally, acquisition or extinction of rights by lapse of time. Claim must be based on the actual and continuous user; enjoyment must be of right; the user must generally be by tenant in fee simple against another tenant in fee simple who has acquiesced in that user. Prescription at common law required proof of: user since time immemorial; user nee vi, nee clam, nee precario; continuous user. |
