part performance Equitable doctrine, restricted to contracts related pre-eminently to land, whereby the defendant who has acquiesced in the plaintiffs performance of a contract is barred from pleading absence of writing. The act of part performance must be exclusively referable to the contract and must be an act of real performance (not merely an act in preparation for the performance). |
