mitigation 1. Diminution, e.g., of some penalty. Plea in mitigation of sentence may be heard at the end of the trial. Nothing may be urged in mitigation which could have constituted a defence to the offence charged. 2. Mitigation of damages: it is the duty of the plaintiff to take all reasonable steps to mitigate the loss caused by a breach of contract. |
