lapse

Failure of a legacy or devise because of the death of the intended legatee or devisee before that of the testator. Doctrine of lapse does not apply: to beneficiaries under a secret trust: in case of entailed interest if the devise leaves descendants capable of inheriting who are living at the time of the testators death to a similar bequest of personality): in case of a legacy or device to a child or other issue of he testator if the legatee or devisee leaves issue living at the time of the testators death.
