delegated legislation Legislation by some person or body under authority given to that person or body by statute, e.g. Orders in Council, Regulations or Rules. Such delegated or subordinate legislation is controlled by Parliament in that the Orders or Rules are printed and laid before parliament which may then debate them. |
delegated legislation This consists of orders, rules regulations, directions, by laws, etc. made by a person or body other than the legislative authority by virtue of powers conferred by the statute. It is also called subordinate legislation or administrative legislation. Here is a combination of two organs of the Government-Legislative and Executive. The legislative power is the power to lay down the law for people in general, whereas administrative power is the power to lay down the law for them individually or in some particular case. But there are cases where it becomes difficult to apply this test. The Indian Supreme Court has held that the power to fix prices is administrative while the power to fix tax rates is legislative. |
