burden of proof Burden of proof means the duty of proving a disputed assertion or charge. The most prominent cannon of evidence is that the point in issue is to be proved by the party who asserts the affirmative. When a person is bound to prove the existence of any fact, it is soid that the burden of proof lies on that person. |
