amendment The correction of some error or omission, or the curing of some defect, in judicial proceedings. In criminal proceedings, the amendment of indictments is now governed by the Indictments Act 1915, s.5. The Crown Court may, in the course of hearing an appeal, correct any error or mistake in the order or judgment under appeal (Courts Act 1971, s.9). In civil proceedings in the High Court, the court may, at any stage of the proceedings, and on any terms as to costs or otherwise amend any defect or error in any proceedings, and all necessary amendments shall be made. A writ or statement of claim may be amended once without leave (Ord.20). |
